Q. Section 6.1.1 permits the Supplier 'to use a more advanced wind turbine model… from the same manufacturer' with written approval from the Distributor. Will this written approval be given as long as Supplier provides the information specified in the following paragraph, demonstrating the performance, technological maturity and reliability of the new turbine? Would a turbine change to a similar model from another manufacturer be permitted if the same information about performance, technological maturity, and reliability is provided to the Distributor's satisfaction, in the event that the turbine originally proposed no longer allows the Supplier to fulfil the obligations of the RFP, such as i) incurring significant penalties to the Supplier (such as domestic content penalties), ii) deliveries unavailable to support the required COD timeline, iii) the manufacturer is no longer in business or supplying turbines to the Quebec market, iv) or other factors outside the Supplier's control?

A. Article 6.1.1 of the Standard Contract sets out the terms and conditions for requests to change the model of wind turbine. Under this section, the Supplier may request that the Distributor use a more advanced model of wind turbine from the same wind turbine manufacturer. The substitution of wind turbines by another wind turbine manufacturer is not provided for in the Standard Contract. Depending on the circumstances, the Distributor may, however, consider such a request from the Supplier, which would not have the effect of modifying the Supplier's obligations under the electricity supply contract if the Distributor were to accept such substitution.
R. L’article 6.1.1 du Contrat-type présente les modalités relatives aux demandes de changement de modèle d’éoliennes. En vertu de cet article, le Fournisseur peut demander au Distributeur d’utiliser un modèle d’éoliennes plus évolué du même manufacturier d’éoliennes. La substitution d'éoliennes par un autre manufacturier d’éoliennes n’est pas prévue au Contrat-type. Selon les circonstances, le Distributeur pourrait toutefois évaluer une telle demande du Fournisseur, laquelle ne pourrait pas avoir pour conséquence de modifier les obligations du Fournisseur en vertu du contrat d’approvisionnement en électricité si le Distributeur acceptait ladite substitution.
